Terms of Service

1. Acceptance of Terms

By accessing or using ohmybaddie.com (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We reserve the right to update these terms at any time; changes are effective upon posting.

2. Eligibility

You must be at least 18 years old to use the Platform. By creating an account, you represent that you are 18 or older and that all information you provide is accurate and complete. Creators must be residents of the United States, Canada, Australia, or New Zealand. Fans may access the Platform from any country where the content is legal.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts for violations of these terms.

4. Subscriptions, Tips & Payments

All payments on the Platform, including subscriptions, coin purchases, and gifts, are processed through Stripe. By making a purchase, you agree to Stripe's terms and ours.

All sales are final. Subscription fees, coin purchases, and gifts are non-refundable. Canceling a subscription stops future billing but does not entitle you to a refund for the current billing period. Chargebacks or payment disputes may result in immediate account suspension or termination.

4a. Creator Fees & Payouts

Creators earn revenue from fan subscriptions and gifts. The following fees apply to all creator transactions:

• Processing fee (3.7% + $0.30): Applied to all transactions processed through Stripe, including fan payments and creator payouts.
• Service fee (15%): Our platform commission on all creator earnings, including subscriptions and gifts.

Creators may withdraw their earnings once their available balance reaches or exceeds $10.00. New earnings are subject to a 7-day settlement period before becoming available for withdrawal. Payouts are processed through Stripe Connect and sent to the creator's linked bank account. The processing fee (3.7% + $0.30) is deducted from each payout.

Refunds and chargebacks: If a refund is issued, the full transaction amount is deducted from the creator's balance. The platform's service fee is retained. Stripe's processing fees are non-refundable. Chargeback fees imposed by Stripe are deducted from the creator's balance. Creators are responsible for all tax obligations on their earnings.

4b. Australia and New Zealand Consumers - Cooling-off Waiver

If you are a consumer in Australia or New Zealand, the Australian Consumer Law (ACL) or the New Zealand Fair Trading Act 1986 (FTA) may otherwise give you a 14-day cooling-off period for subscription services. By subscribing and accessing Creator content, you expressly request immediate performance of the subscription service and acknowledge that any right to a cooling-off period is waived once Creator content is delivered to you. This waiver does not affect any other rights you have under the ACL or FTA (including the right to refunds for services not provided with due care and skill).

5. Account Deletion and Data Retention

You may delete your account at any time from your Settings page. Upon deletion, your personal information (username, email, display name, bio, avatar, and banner) is permanently removed from our systems.

Retained data: Certain information is retained as required by law or for legitimate business purposes:

• Transaction records are retained for tax and financial compliance, as required by applicable law.
• Posted content (media, captions) remains accessible to users who purchased or unlocked it, as those users have a legitimate interest in accessing content they paid for.
• Messages sent to other users remain accessible to their recipients, who have a legitimate interest in their conversation history.
• Payout records are retained for tax reporting purposes.

Creators: Before deletion, active subscriptions are canceled, and any available balance above the minimum payout threshold is automatically paid out. Balances below the threshold are forfeited.

Fans: Active subscriptions are canceled immediately. Unused coin balances are forfeited.

Deletion is irreversible. If you would like a copy of your data before deletion, please contact support.

6. Creator Content

Creators are solely responsible for the content they post. ohmybaddie.com acts as a platform and does not endorse, verify, or guarantee any creator content. We are not liable for any content posted by users. Creators represent that they own or have all necessary rights to their content.

7. Prohibited Conduct

You agree not to:

• Post hateful content, violent content, or extremist content (see our Acceptable Use Policy)
• Monetize hateful, violent, or extremist content through any means on the Platform
• Post illegal, abusive, or harassing content
• Post sexually explicit content, including nudity, sexual acts, or pornographic material
• Infringe on any third party's copyright, trademark, or other rights
• Impersonate another person or entity
• Attempt to circumvent payment systems or access gated content without authorization
• Use the Platform for any unlawful purpose
• Share or redistribute creator content outside the Platform without consent

8. DMCA / Copyright Infringement

We respect the intellectual property rights of others. If you believe content on the Platform infringes your copyright, please contact us at [email protected] with the following information: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, and your signature (electronic or physical). We will respond to valid DMCA notices and may remove infringing content.

9. Limitation of Liability

ohmybaddie.com is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all liability for damages arising from your use of the Platform, including but not limited to direct, indirect, incidental, and consequential damages. Our total liability shall not exceed the amount you have paid us in the six months preceding the claim.

10. Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes arising from these terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Florida.
